Civil Law
In almost every aspect of our daily lives, whether we realize it or not, we are intertwined with civil law. From shopping to renting a house, and even in our relationships with our families, the rules of civil law come into play. In short, civil law in Turkey is a branch of law that regulates the relationships between individuals and determines the rights and responsibilities arising from these relationships. Many areas, from commerce and debts to family law and inheritance, fall within the scope of civil law.
Civil law, on the one hand, protects the rights of individuals, and on the other hand, helps resolve potential disputes. For example, let’s say we borrowed money from a friend and didn’t make the payment when it was due. In this case, our friend, as the creditor, has the right to seek legal recourse under the guarantee of civil law. Or consider a marriage; all processes from getting married to getting divorced, from child custody to property division, take place within the framework of civil law.
Contracts are one of the most important building blocks of civil law. A contract signed by the mutual consent of two parties is binding on both parties and protects their rights. For instance, the lease agreement we sign when renting a house clearly sets out the rights and responsibilities of both the landlord and the tenant. If the contract is not complied with, the parties can resort to legal action. The principle of the rule of law comes into play at this very point; everyone must abide by the contracts they have signed and seek their rights within this framework.
Although courts play an important role in resolving civil law disputes, alternative dispute resolution methods such as mediation and conciliation are becoming increasingly common today. These methods both provide faster results and save on court costs. Thus, problems between parties can be resolved more easily and amicably.
In summary, civil law plays a key role in ensuring social order by guaranteeing the rights of individuals. Civil law legislation in Turkey is also constantly updated in parallel with changing social needs. This system, which is based on justice and equality, will always continue to hold an important place in individuals’ lives.
